All services provided by Magical Memory Vacations including but not limited to the making available of the website, browser extension, mobile applications, email newsletters, social media profiles, and content on any of the mentioned channels, are referred to in these terms and conditions as the "Services".

These Terms may be changed by Magical Memory Vacations in the future. Your continued use of the Services after any such changes constitutes your acceptance of the new or modified Terms.

Travel Destinations

You are responsible for ensuring that you meet foreign entry requirements and that your travel documents are in order. Magical Memory Vacations shall not be liable for damages or losses that may result from travel to any destinations. Magical Memory Vacations urges passengers to review travel prohibitions, warnings, announcements, and advisories issued by the relevant government authorities before booking travel to international destinations.

BY OFFERING TRAVEL SERVICES TO PARTICULAR INTERNATIONAL DESTINATIONS, MAGICAL MEMORY VACATIONS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Indemnification

You agree to indemnify and hold harmless Magical Memory Vacations, its affiliates, and their shareholders, directors, officers, employees, contractors, and agents from and against any claims, causes of action, demands, losses, fines, penalties, damages or other costs or expenses of any kind arising out of or relating to your conduct, your use of the Services, your breach of this Agreement, or your violation of any law or the rights of a third party.

Submissions

You agree that any materials provided by you in the form of email or submissions to Magical Memory Vacations, or postings on Magical Memory Vacations' website or social media accounts (collectively, "Submissions"), are non-confidential and shall become the sole property of Magical Memory Vacations. Magical Memory Vacations shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use of these materials for any purpose without acknowledgment or compensation to you.

Applicable Law and Dispute Resolution

To the extent permitted by law, this Agreement and the provision of our Services shall be governed by the laws of the Province of British Columbia, without reference to conflict of laws provisions, and the Federal laws of Canada applicable in the Province of British Columbia, and you shall attorn to the exclusive jurisdiction of the courts of the Province of British Columbia.

Modification

We may update these Terms at any time, in our sole discretion. Modifications will be effective on the date that they are posted to the Magical Memory Vacations website. If you continue to use the Services after we have posted updated Terms, you are agreeing to be bound by the updated Terms.

Severability

If any provision of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
